Order for Production of Government Documents

scalesthumbnail-copy.jpg After Judge Molloy conducted an in camera review of government attorney notes taken in preparation of a mock examination, he ordered that W.R Grace’s motion to compel be granted.  The notes were taken January 9, 2009, by attorney Goldsmith in preparation of trial.

The mock examination notes are in regards to a former W.R. Grace corporate executive, Robert Locke, a key witness for the government.

Judge Molloy found the material was favorable to the accused, and subject to production under Brady v. Maryland, 373 U.S. 83 (1963).  The order stated that in all other respects, Grace’s motion to compel production of government attorney notes was denied.
