If the Montana University System (MUS) joins the State of Montana in negotiating with MPEA on behalf of two distinctly separate bargaining units, the MUS may be considered to have forfeited their constitutional rights as a separate public employer. One of two outcomes are probable in this scenario:
  • The Montana University System could hope to impact salary negotiations for all State of Montana employees in a manner which meets the unique needs of University System employees;
  • The Montana University System could concede that salary issues and other conditions of employment are similar to those of all other State of Montana agencies and thus, one negotiated agreement is acceptable for all entities.
